Marquez penalty to go to MotoGP Court of Appeal

The Court of Appeal has been referred Honda's appeal against Marc Marquez's penalty for his collision with Miguel Oliveira at the MotoGP Portuguese Grand Prix.

Oliveira was taken out on the third lap of last Sunday's grand prix in Portugal when Marquez lost control under braking for Turn 3.

Both were rendered unable to compete in the Argentina Grand Prix this weekend, with Marquez undergoing surgery on Monday for a hand fracture and Oliveira recuperating from tendon damage.

Marquez was brought before the FIM stewards and given a double long-lap penalty for the Argentina Grand Prix.

This was issued prior to Honda's announcement that he would withdraw from Argentina due to his injury, which would have rendered the penalty null and void.

Tuesday, however, the FIM released an amended statement indicating that Marquez's suspension would be enforced in the first round he is able to return to.

Honda announced on Wednesday that it would file an appeal in response to the decision, which it deemed to be in violation of the rules.

After a Thursday morning meeting in Argentina, the FIM appeal stewards referred this case to the Court of Appeal.

The FIM stated:

"Mr. Marc Marquez and the team, HRC - REPSOL HONDA TEAM (Alberto Puig), filed a written appeal on 29/03/2023 at 02h16 (am) to the FIM Appeal Stewards with a deposit of 1320 Euros.

The appeal challenges the FIM MotoGP Stewards Panel's 28 March 2023 Sanction against Marc Marquez, Rider #93, in relation with the prior "Notification of Sanction" on 26 March 2023.

The FIM MotoGP-Stewards Panel issued a "Double Long Lap Penalty for the GRAN PREMIO MICHELIN® DE LA REPUBLICA ARGENTINA MotoGP- Race" on 26/03/2023.

The FIM MotoGP Stewards Panel gave a "Double Long Lap Penalty" to Marc Marquez on March 28, 2023, for the next MotoGP race in which he could compete.

2. Method

The appeal was filed properly, with the correct fee, and within the FIM Administration's 24-hour limit (before 29 March 2023, 07:57 CEST).

FIM Appeal Stewards met online on 29/03/2023. The FIM Appeal Stewards received the FIM MotoGP Stewards Panel's 26 March 2023 FIM Sanction notice.

3. FIM Appeal Stewards:

Appellant's two parts are:

1) FIM Stewards Panel "Application of Sanction" veracity 2) A halt of the "Application of the Sanction" temporary execution.

The FIM Appeal Stewards send the case to the MotoGP Court of Appeal for a fair resolution based on the case's conditions and Mr. Marc Marquez and HRC - REPSOL HONDA TEAM's appeal.

4. Decision

Accordingly, the FIM Appeal Stewards decide:

"To receive the Appeal (art. 3.3.3.2) and refer the case to the MotoGP Court of Appeal"

The Court of Appeal review must occur before Marquez's return at the Americas GP, but the date is unknown.

RNF called for harsher penalties for riders engaged in incidents like the Marquez/Oliveira one before the FIM revised its penalty notice.
